Booking Terms & Conditions

By submitting a booking inquiry, deposit, payment, or signed agreement for use of 25 SOUTH, the Client agrees to the following Terms & Conditions. These Terms & Conditions are intended to govern venue inquiries, event rentals, private bookings, promoter events, entertainment events, and related use of the premises.
1. Venue Use
25 SOUTH is available for private events, corporate events, social celebrations, promoter events, entertainment productions, community events, and approved special events.
All events are subject to venue approval, date availability, staffing availability, operational requirements, licensing restrictions, City of Pontiac requirements, State of Michigan laws, and final execution of a written venue rental agreement.
Submission of a booking inquiry does not guarantee approval, availability, pricing, or confirmation of an event date.
2. Booking Approval
All booking requests must be reviewed and approved by 25 SOUTH management.
25 SOUTH reserves the right to approve, deny, modify, or cancel any booking request at its sole discretion, including but not limited to events that may present safety concerns, legal concerns, security concerns, reputational concerns, licensing concerns, or operational conflicts.
A booking is not confirmed until all required documents are completed, the required deposit has been paid, and written confirmation has been issued by 25 SOUTH.
3. Payments, Deposits & Final Balance
A non-refundable deposit may be required to secure an approved event date.
The remaining balance must be paid by the deadline stated in the event agreement. Failure to pay the balance by the required deadline may result in cancellation of the booking and forfeiture of any deposit or payments previously made.
Additional costs may apply for staffing, security, cleaning, bar service, extended hours, equipment, production needs, entertainment, damage, overtime, vendor access, or special requests.
4. Cancellation Policy
All cancellations must be submitted in writing.
Deposits are non-refundable unless otherwise stated in a signed agreement. If the Client cancels the event after confirmation, 25 SOUTH may retain all or part of payments made, depending on the timing of cancellation, expenses incurred, staff scheduling, lost booking opportunity, and other operational impacts.
25 SOUTH reserves the right to cancel or terminate any event due to unsafe conditions, illegal activity, failure to comply with venue rules, nonpayment, misrepresentation, security risks, force majeure events, licensing restrictions, or government orders.
5. Event Hours & Overtime
The Client is responsible for adhering to the approved event start time, end time, setup time, breakdown time, and guest departure time.
Any use of the venue beyond the approved rental period may result in additional overtime charges. Overtime is subject to venue approval and may not be available for all events.
6. Alcohol, Bar Service & Michigan Liquor Compliance
All alcohol service must comply with the Michigan Liquor Control Code of 1998 and all applicable rules and regulations. Michigan law prohibits selling, furnishing, or giving alcoholic liquor to a minor, and also restricts furnishing alcohol to visibly intoxicated persons under Michigan liquor liability provisions.
No outside alcohol may be brought onto the premises unless expressly authorized in writing by 25 SOUTH and permitted by applicable law.
25 SOUTH reserves the right to refuse service to any guest, remove any guest, stop alcohol service, require identification, limit consumption, or end an event if alcohol-related safety or legal concerns arise.
Guests must be at least 21 years of age to purchase, possess, or consume alcoholic beverages.
7. Smoking, Tobacco & Outdoor Cigar Vendor Use
25 SOUTH does not operate as a permanent cigar lounge.
Smoking is not permitted inside the venue except where expressly allowed by applicable law. Michigan law generally prohibits smoking in public places, subject to limited statutory exceptions.
A seasonal outdoor cigar vendor activation may be permitted for approved Wednesday summer programming only, subject to venue approval, vendor compliance, local requirements, insurance requirements, and all applicable Michigan laws. Michigan law contains specific requirements for cigar bar exemptions, and any cigar-related activity must comply with applicable statutes and licensing requirements.
25 SOUTH reserves the right to deny, limit, relocate, or terminate any cigar vendor activation at any time.
8. Security Requirements
Security requirements are determined by 25 SOUTH based on event type, expected attendance, alcohol service, entertainment, public access, promoter involvement, risk factors, and venue policy.
The Client may be required to pay for venue-approved security personnel. Outside security may not be used unless approved in writing by 25 SOUTH.
25 SOUTH reserves the right to remove any guest, performer, vendor, promoter, or participant for disorderly conduct, intoxication, threats, violence, harassment, property damage, illegal activity, weapons possession, noncompliance, or behavior deemed unsafe.
9. Guest Conduct
The Client is responsible for the conduct of all guests, vendors, performers, promoters, invitees, contractors, and participants associated with the event.
The following are strictly prohibited unless expressly authorized by 25 SOUTH and allowed by law:

unauthorized alcohol

unauthorized vending

fighting or disorderly conduct

property damage

confetti, glitter, open flame, pyrotechnics, or smoke effects

unauthorized amplified sound
-
unauthorized use of stage, equipment, bar, storage, or staff areas
-
conduct that violates law, venue policy, or public safety standards
25 SOUTH may end an event immediately if guest conduct creates a safety, legal, or operational concern.
10. Damage & Cleaning
The Client is responsible for any damage to the venue, furniture, fixtures, equipment, restrooms, bar areas, stage, décor, exterior areas, or neighboring property caused by the Client, guests, vendors, performers, promoters, contractors, or invitees.
Additional cleaning fees may apply if the venue is left in an unreasonable condition.
25 SOUTH may charge the Client for repairs, replacement, excessive cleaning, missing property, or damage-related expenses.
11. Vendors, Promoters & Third Parties
All outside vendors, promoters, entertainers, DJs, caterers, decorators, production teams, security teams, photographers, videographers, cigar vendors, food vendors, and contractors must be approved by 25 SOUTH before the event.
25 SOUTH may require proof of insurance, licensing, permits, identification, vendor agreements, arrival times, setup plans, load-in instructions, and compliance documentation.
The Client remains responsible for all approved and unapproved vendors connected to the event.
12. Entertainment, Music & Performances
All entertainment must be approved by 25 SOUTH.
25 SOUTH reserves the right to control sound levels, performance times, stage access, equipment use, lighting, event flow, and entertainment conduct.
Events involving ticket sales, public promotion, celebrity appearances, live performances, DJs, concerts, or promoter-led activity may be subject to additional requirements, including but not limited to security, staffing, insurance, ticketing controls, production approval, marketing approval, and settlement terms.
13. Capacity & Occupancy
The Client must comply with all venue capacity limits, fire code requirements, occupancy restrictions, and safety requirements.
25 SOUTH reserves the right to limit attendance, stop entry, remove guests, or adjust the event layout to comply with safety and occupancy requirements.
The Client may not exceed the approved guest count.
14. Marketing, Promotion & Use of Venue Name
The Client may not use the 25 SOUTH name, logo, address, brand assets, images, or likeness in public marketing materials without prior written approval.
All public promotions, flyers, social media posts, ticketing pages, event descriptions, sponsor mentions, celebrity mentions, and advertising materials must be approved by 25 SOUTH before publication.
25 SOUTH reserves the right to require edits, removal, or cancellation of any unauthorized promotional material.
15. Ticketed Events & Public Promotions
Ticketed events, public events, promoter events, and paid-entry events require written approval.
The Client is responsible for all ticketing representations, guest communication, refunds, artist claims, promoter claims, sponsor claims, and advertised event details unless otherwise stated in writing.
25 SOUTH reserves the right to require guest lists, ticket reports, presale reports, box office controls, door controls, settlement reports, and event staffing plans.
16. Insurance & Liability
25 SOUTH may require the Client to provide a certificate of insurance naming 25 SOUTH, its owners, operators, landlord, employees, agents, and affiliates as additional insureds.
The Client assumes responsibility for risks associated with the event and agrees to indemnify, defend, and hold harmless 25 SOUTH, its owners, operators, employees, partners, landlord, affiliates, contractors, and representatives from claims, damages, losses, liabilities, injuries, costs, legal fees, and expenses arising out of or related to the event, except where prohibited by law.
17. Assumption of Risk
The Client and guests acknowledge that attending or hosting an event may involve risks, including but not limited to slips, falls, crowd movement, alcohol-related incidents, entertainment-related risks, equipment use, vendor activity, and acts of third parties.
Guests enter and participate at their own risk, subject to applicable law.
18. Photography, Video & Media Release
By entering the venue, guests acknowledge that photography and video may occur.
25 SOUTH may use event images, video, or general venue footage for promotional, marketing, archival, social media, or business purposes unless otherwise prohibited in writing before the event.
Clients hosting private or confidential events must notify 25 SOUTH in writing of any media restrictions before the event date.
19. Discounts
Pontiac residents may qualify for preferred booking discounts on eligible private events. Proof of Pontiac residency may be required.
Registered nonprofit organizations may qualify for 25% off eligible venue booking costs. Proof of nonprofit status may be required. The nonprofit discount applies to eligible venue booking fees only and does not automatically apply to security, staffing, bar minimums, cleaning, entertainment, production, vendor fees, damages, overtime, or other additional costs.
Discounts are subject to approval, availability, event type, date, time, rental package, and written confirmation by 25 SOUTH.
19. Discounts
Pontiac residents may qualify for preferred booking discounts on eligible private events. Proof of Pontiac residency may be required.
Registered nonprofit organizations may qualify for 25% off eligible venue booking costs. Proof of nonprofit status may be required. The nonprofit discount applies to eligible venue booking fees only and does not automatically apply to security, staffing, bar minimums, cleaning, entertainment, production, vendor fees, damages, overtime, or other additional costs.
Discounts are subject to approval, availability, event type, date, time, rental package, and written confirmation by 25 SOUTH.
20. Accessibility & Equal Access
25 SOUTH intends to operate in compliance with applicable accessibility, civil rights, and public accommodation laws. Clients must notify 25 SOUTH in advance of any accessibility-related needs, special accommodations, or event setup requirements.
21. Force Majeure
25 SOUTH shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, severe weather, fire, flood, power failure, public emergency, civil unrest, labor disruption, government order, licensing restriction, pandemic-related order, public safety issue, or other event beyond reasonable control.
22. Governing Law & Venue
These Terms & Conditions shall be governed by and interpreted under the laws of the State of Michigan.
Any dispute arising from these Terms & Conditions, venue use, event rental, or related agreement shall be subject to the jurisdiction of courts located in the State of Michigan, unless otherwise required by law or stated in a signed agreement.
23. Right to Modify Terms
25 SOUTH reserves the right to update, revise, amend, or modify these Terms & Conditions at any time.
The version in effect at the time of booking confirmation or signed agreement shall control unless otherwise stated in writing.
24. Acknowledgment
By submitting a booking inquiry, signing a venue agreement, making payment, paying a deposit, promoting an event, or using the venue, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
